The petitioner, Ashok Wamanrao Bankar, was a Clerk-cum-Cashier (later Single Window Operator) at Allahabad Bank's Jamb (Parbhani) branch. He was charged with misappropriation of amounts while functioning as Cashier. In a disciplinary enquiry, the Disciplinary Authority imposed a penalty of compulsory retirement by order dated 25.11.2011. Despite this penalty, the bank did not pay him superannuation benefits such as pension, provident fund, gratuity, commutation of pension, and leave encashment. The bank took the stand that since criminal proceedings were pending against the petitioner, the superannuation benefits could not be released. The petitioner filed a writ petition seeking implementation of the penalty order and payment of all benefits with interest. During the pendency of the petition, the petitioner died and his legal heirs (wife and son) were brought on record. The Court heard the matter and held that once the disciplinary authority imposed a penalty of compulsory retirement, the employee is entitled to all superannuation benefits. The pendency of criminal proceedings cannot be a ground to withhold such benefits, as the disciplinary proceedings and criminal proceedings are independent. The Court directed the bank to pay all superannuation benefits to the legal heirs with interest at 6% per annum from the date of superannuation (which would be the date of the penalty order) till actual payment, within eight weeks.
