The petitioner husband and respondent wife obtained a decree of divorce by mutual consent under Section 13-B of the Hindu Marriage Act, 1955 on 10th October 2017. The civil court recorded that the husband paid Rs.2,00,000 to the wife and daughter towards maintenance, education, and all responsibilities, and the wife gave up her right to maintenance. Two months later, the wife filed an application under Section 125 Cr.P.C. before the Judicial Magistrate First Class, Chalisgaon for maintenance for her minor daughter, suppressing the fact of receipt of Rs.2,00,000. The magistrate allowed the application. The husband challenged the order by way of criminal writ petition. The High Court held that the wife's suppression of material fact amounts to fraud on the court, and the maintenance order cannot be sustained. The court quashed the impugned order and allowed the petition.
