The petitioner, Bhagatram Ravalmal Balani, was elected as a councillor of the Jalgaon Municipal Corporation in 2018 on a BJP ticket. After the election, the 57 BJP councillors elected the petitioner as their group leader, and he informed the Divisional Commissioner accordingly under Rule 3 of the Maharashtra Local Authority Members' Disqualification Rules, 1987. Subsequently, respondent No. 5, Dilip Babanrao Pokale, also claimed to be the group leader and submitted a separate communication. The Divisional Commissioner, by an order dated 22.09.2021, declared respondent No. 5 as the group leader of the BJP municipal party. The petitioner challenged this order, arguing that the Commissioner had no jurisdiction to decide who the group leader is. The court examined the provisions of the Maharashtra Local Authority Members' Disqualification Act, 1986 and the Rules framed thereunder. It noted that the Act only empowers the Commissioner to decide questions of disqualification of members for defection, not to determine the group leader. Rule 3 merely requires the group leader to furnish information to the Commissioner, but does not confer any adjudicatory power on the Commissioner.
