The respondent-landlord filed a suit against the petitioner-tenants seeking eviction under Section 16(1)(e)(ii) and (g) of the Maharashtra Rent Control Act, 1999 on grounds of unlawful subletting and bona fide requirement, in the Small Causes Court, Nagpur, in 2011. An earlier proceeding for fixation of fair rent had resulted in an order fixing rent at Rs.10 per sq. ft. per month; the tenants' appeal against that order was pending. On 24.02.2016, the parties jointly applied for a compromise decree under Order XXIII Rule 3 CPC. The terms required the tenants to vacate by 30.11.2018, pay rent at Rs.20,000 per month from 01.01.2016 until vacation, and in default pay damages at Rs.1200 per day. The landlord filed Civil Revision Application No.22/2019 under Section 34(4) of the Rent Act before the District Court, which allowed the revision on 09.12.2021, quashed the executing court's order, rejected the tenants' objection, and restored the execution. Aggrieved, the tenants filed the present writ petition. The question that arises for consideration in this petition is, whether a compromise decree passed by the Court of Small Causes, was an executable decree or a nullity or that it had merely recorded terms of compromise that gave rise to a fresh landlord-tenant relationship with all the protection afforded by the Maharashtra Rent Control Act, 1999. The compromise between the parties was reduced to a private arrangement without reference to any of the grounds of eviction specified in the said Rent Control Act and that therefore, the decree was incapable of execution. The parties to the present suit i.e. the plaintiff and the defendants are desirous of settling amicably the pending case... the defendants have agreed to vacate the suit premises... on or dated 30.11.2018... on failure to hand over the possession... the defendants shall be liable for damaged for the occupation of the suit premises @ Rs.1200/- per day.

Procedural History

In 2011, the respondent-landlord filed Regular Civil Suit No.01/2011 before the Small Causes Court, Nagpur, seeking eviction of the petitioners-tenants under Section 16(1)(e)(ii) and (g) of the Maharashtra Rent Control Act, 1999. Earlier, the respondent had obtained an order for fixation of fair rent in M.J.C. No.21/2004, against which the petitioners filed Misc. Civil Appeal No.14/2016. On 24.02.2016, during pendency of the suit and the said appeal, the parties jointly applied under Order XXIII Rule 3 CPC for a compromise decree. The Small Causes Court disposed of the suit in terms of the compromise, recording that the tenants would vacate by 30.11.2018, pay rent at Rs.20,000 per month from 01.01.2016 until vacation, and in default pay damages of Rs.1200 per day. The tenants failed to vacate by the deadline, and on 07.12.2018, the respondent filed execution proceeding SD No.156/2018. The petitioners objected under Section 47 CPC contending the decree was not executable. By order dated 16.11.2019, the executing court allowed the objection and dismissed the execution as premature. The respondent filed Civil Revision Application No.22/2019 under Section 34(4) of the Rent Act before the District Court. The District Court, by judgment and order dated 09.12.2021, allowed the revision, set aside the executing court's order, rejected the objection, and restored the execution proceeding. The petitioners then filed the present writ petition challenging the District Court's order.
