Case Note & Summary
The petitioner-Society, which runs an educational institution, challenged an order of the appellate authority under the Maharashtra Educational Institutions (Management) Act, 1976. The Director of Education had initially taken over the management of the institution for a period of two years under Section 3(1) of the Act, effective from 02.11.2017 when the Board of Administrators took charge. The Society appealed under Section 3(4) of the Act, but the appeal was dismissed on 12.02.2021, well after the two-year period had expired. The appellate authority directed that the appointment of the Administrator continue. The Society argued that the initial order ceased to operate after two years, and there was no legal basis for the appellate authority to extend the administrator's tenure. The respondents contended that the appeal was pending and the appellate authority could pass any order. The High Court analyzed Section 3(1) and Section 3(4) of the Act, noting that the takeover under Section 3(1) is for a maximum period of two years, and the appellate authority under Section 3(4) can confirm, modify, or rescind the order but cannot extend the period beyond two years without a fresh order. Since the two-year period had expired before the appellate order, the takeover order had ceased to operate. The court held that the appellate authority's direction to continue the administrator was without legal basis. The court allowed the petition, quashed the appellate order insofar as it directed continuation of the administrator, and directed the respondents to hand over management to the Society within four weeks.

Nature of Litigation
Writ petition challenging the appellate authority's order directing continuation of administrator beyond the initial two-year takeover period under the Maharashtra Educational Institutions (Management) Act, 1976.
Remedy Sought
Petitioner-Society sought quashing of the appellate order and restoration of management of the educational institution to the Society.
Filing Reason
The appellate authority dismissed the Society's appeal against the takeover order and directed continuation of the administrator beyond the two-year period, which the Society contended was without legal basis.
Previous Decisions
The Director of Education passed an order under Section 3(1) of the Act on 12.05.2017 taking over management for two years. The Board of Administrators took charge on 02.11.2017. The Society's appeal under Section 3(4) was dismissed on 12.02.2021, with a direction for continuation of the administrator.
Issues
Whether the appellate authority under Section 3(4) of the Maharashtra Educational Institutions (Management) Act, 1976 can direct continuation of an administrator beyond the initial two-year period of takeover under Section 3(1) of the Act.
Submissions/Arguments
Petitioner: The takeover order under Section 3(1) was for two years only; after expiry, the order ceased to operate. The appellate authority could not extend the period without a fresh order. The management should be restored to the Society.
Respondents: The appeal was pending and the appellate authority could pass any order including continuation of the administrator.
Ratio Decidendi
Under Section 3(1) of the Maharashtra Educational Institutions (Management) Act, 1976, the takeover of management is for a maximum period of two years. The appellate authority under Section 3(4) can confirm, modify, or rescind the order but cannot extend the period beyond two years without a fresh order. Once the two-year period expires, the takeover order ceases to operate, and the management must be restored to the Society.
Judgment Excerpts
The Director while invoking the provisions of Section 3(1) of the Act of 1976 ordered that the management of the educational institution was being taken over for a period of two years during which period the Administrator was to look after the management of the educational institution.
On expiry of the period of two years from 02.11.2017 when the management was taken over, the order passed by the Director ceased to operate. There was no legal basis for the appellate Authority to have thereafter directed continuation of the Administrator.
The appellate Authority while confirming that order directed continuation of the appointment of the Administrator. This order was passed on 12.02.2021 which was much beyond the period of two years for which the management had been taken over initially.
Procedural History
The Director of Education passed an order under Section 3(1) of the Maharashtra Educational Institutions (Management) Act, 1976 on 12.05.2017 taking over management of the petitioner's educational institution for two years. The Board of Administrators took charge on 02.11.2017. The Society filed an appeal under Section 3(4) of the Act, which was dismissed by the appellate authority on 12.02.2021, with a direction for continuation of the administrator. The Society then filed the present writ petition before the Bombay High Court, Nagpur Bench.
