The petitioner, M/s F.A. Construction, a partnership firm, had availed a loan of Rs. 98,00,000 from Andhra Bank (now Union Bank of India) under the Stand-up India Scheme. As security, the petitioner created a mortgage by deposit of title deeds of a property owned by M/s Nircon Construction. The loan was fully repaid, and the petitioner requested the return of the mortgage documents by letter dated August 29, 2020. The respondent bank refused, claiming a general lien over the documents because the petitioner and its associate concerns had outstanding accounts with the bank's Santacruz Branch.
