The petitioners, residents of Waluj Industrial Area, Aurangabad, and one of them being an industrial unit holder, challenged the action of the Maharashtra Industrial Development Corporation (MIDC) in converting an open space (Plot No. O/S032, also known as X-385) into a commercial plot and allotting it to respondent No. 4, Dr. Amar Kodgire, through e-bidding. The open space was originally reserved in the development plan for recreational purposes. The petitioners contended that the conversion was illegal, arbitrary, and contrary to the provisions of the Maharashtra Industrial Development Act, 1961, and the development plan. They sought quashing of the e-bidding process and the allotment order dated 28.12.2017.
