Case Note & Summary

The petitioner, Yogendra Rangari, filed a writ petition challenging the legality and correctness of the Minutes of Meeting dated 12.02.2021, which recorded the passing of a no confidence motion against him as Vice President of the Municipal Council, Kanhan Pipri. During the pendency of the petition, a no confidence motion was passed, and subsequently, an election was held for the post of Vice President, resulting in the election of another person. The petitioner was present and aware of this election but did not implead the newly elected Vice President as a party respondent. The respondents raised a preliminary objection regarding maintainability due to non-joinder of necessary party. The petitioner argued that there was no need to join the newly elected Vice President because an earlier court order dated 01.03.2021 allowed him to continue as a member and participate in voting, and that further steps taken by the Municipal Council would be subject to the outcome of the petition. The court held that the newly elected Vice President is a necessary party whose rights would be directly affected by the outcome of the petition. The court noted that the petitioner was aware of the election and yet did not implead the elected person. Therefore, the petition was dismissed as not maintainable due to non-joinder of necessary party. The court did not address the merits of the challenge to the no confidence motion.

Nature of Litigation

Writ petition challenging the legality and correctness of Minutes of Meeting dated 12.02.2021 recording passing of no confidence motion against the petitioner as Vice President of Municipal Council.

Remedy Sought

Petitioner sought to challenge the no confidence motion and the Minutes of Meeting.

Filing Reason

Petitioner alleged that the no confidence motion was passed illegally.

Previous Decisions

An order dated 01.03.2021 allowed the petitioner to continue as member and participate in voting, and stated that further steps by the Municipal Council would be subject to outcome of the petition.

Issues

Whether the writ petition is maintainable in the absence of the newly elected Vice President as a party respondent.

Submissions/Arguments

Respondents argued that the newly elected Vice President is a necessary party and non-joinder renders the petition not maintainable. Petitioner argued that there was no need to join the newly elected Vice President because the court order dated 01.03.2021 protected his rights and made further steps subject to the petition outcome.

Ratio Decidendi

A person who is elected to a post that is the subject matter of the petition is a necessary party whose presence is essential for effective adjudication. Non-joinder of such a party renders the petition not maintainable.

Judgment Excerpts

He submits that at a time when no confidence motion against the petitioner was just passed and meeting for electing the new Vice President was about to be held, the petitioner was present and was aware of the election of another person in his place as a Vice President of Municipal Council and yet the petitioner has not joined him as party respondent. In the circumstances, we find that the preliminary objection raised on behalf of the respondents is well founded and the petition deserves to be dismissed on the ground of non-joinder of necessary party.

Procedural History

Petitioner filed Civil Writ Petition No. 1136 of 2021 challenging the no confidence motion. On 01.03.2021, an interim order was passed allowing petitioner to continue as member and participate in voting. During pendency, a new Vice President was elected. Respondents raised preliminary objection regarding non-joinder of necessary party. The court heard the preliminary objection and dismissed the petition.
