The petitioner, Dhanuka Agritech Limited, a company incorporated under the Companies Act, 1956, is engaged in manufacturing and marketing crop protection products and agro chemicals. Its products are regulated by the Insecticides Act, 1968, and the packaging and labeling of insecticides must comply with the Insecticides Rules, 1971. On 15.07.2016, the Inspector of Legal Metrology, Akola, seized certain packaged products of the company and issued a memorandum alleging violation of the Legal Metrology Act, 2009 and the Legal Metrology (Packaged Commodities) Rules, 2011. The company responded on 02.08.2016, stating that there was no violation and that the Insecticides Act, 1968, being a special Act, would prevail over the Legal Metrology Act, 2009. The Inspector of Legal Metrology, by communication dated 05.10.2016, rejected the company's stand, asserting that Section 3 of the Legal Metrology Act, 2009 has overriding effect over the Insecticides Act, 1968, and called upon the company to submit a consent letter for compounding the offence.
