The informant mother had lodged a report alleging that on 29.03.2023, the applicant father forcibly took away their minor son, leading to registration of Crime No.431 of 2023 under Section 363 of the Indian Penal Code (IPC) at Gadge Nagar Police Station, Amravati. The applicant father filed a criminal application seeking quashing of the FIR. The core legal issue was whether a father can be booked for the offence of kidnapping for taking away his own minor child from the mother's custody. The Court examined Section 361 IPC which defines kidnapping from lawful guardianship, and noted that the offence requires taking a minor out of the keeping of a lawful guardian without that guardian's consent.
