Case Note & Summary
The judgment concerns two writ petitions under Article 227 of the Constitution of India challenging an order of the Appellate Authority dated 26 October 2010. The Life Insurance Corporation of India (LIC) is the owner of Flat No.2A at Jivan Jyot, Nepean Sea Road, Mumbai, which was occupied by National Insurance Company Ltd. (NIC) as a tenant. LIC initiated eviction proceedings under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971 (PPE Act). The Estate Officer passed an eviction order on 18 December 2009 under Section 5 of the PPE Act, also ordering recovery of arrears of rent with interest under Section 7(1)(2A) and damages with interest under Section 7(2)(2A). NIC appealed, and the Appellate Authority partly allowed the appeal: it set aside the recovery of arrears of rent, reduced the quantum of damages, and kept the eviction order in abeyance pending a decision by a High Power Committee. LIC challenged the reduction of damages and the abeyance clause, while NIC challenged the eviction and damages order. The High Court heard both petitions together. The court examined the provisions of the PPE Act and the powers of the Estate Officer and Appellate Authority. It held that the eviction order was valid as NIC was an unauthorised occupant after termination of tenancy. The court also held that damages must be assessed at market rate and that the Appellate Authority erred in reducing damages without proper justification. The court set aside the abeyance clause and directed NIC to pay damages as determined by the Estate Officer. The petitions were disposed of accordingly.
Headnote
A) Public Premises Act - Eviction - Section 5 - Unauthorised Occupation - LIC sought eviction of NIC from flat owned by LIC - Estate Officer ordered eviction and recovery of arrears and damages - Appellate Authority upheld eviction but reduced damages and kept execution in abeyance pending High Power Committee decision - Held that eviction order is valid and damages must be paid as per market rate (Paras 3-5).
Issue of Consideration
Whether the Appellate Authority's order reducing damages and keeping eviction in abeyance pending High Power Committee decision is sustainable under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971
Final Decision
The High Court disposed of both writ petitions. It upheld the eviction order but set aside the Appellate Authority's reduction of damages and the abeyance clause. The matter was remanded to the Appellate Authority for fresh determination of damages in accordance with law.

Nature of Litigation
Writ petitions under Article 227 of Constitution of India challenging order of Appellate Authority under Public Premises (Eviction of Unauthorised Occupants) Act, 1971
Remedy Sought
LIC sought restoration of damages as per Estate Officer's order and removal of abeyance clause; NIC sought setting aside of eviction and damages order
Filing Reason
Dispute over eviction, arrears of rent, and damages for unauthorised occupation of flat owned by LIC and occupied by NIC
Previous Decisions
Estate Officer passed eviction order dated 18 December 2009 under Section 5 of PPE Act, recovery of arrears of rent with interest under Section 7(1)(2A), and damages with interest under Section 7(2)(2A). Appellate Authority partly allowed appeal on 26 October 2010, setting aside recovery of arrears, reducing damages, and keeping eviction in abeyance pending High Power Committee decision.
Issues
Whether the Appellate Authority's reduction of damages and stay on eviction pending High Power Committee decision is valid under the PPE Act
Whether the eviction order under Section 5 of PPE Act was correctly upheld by the Appellate Authority
Submissions/Arguments
LIC argued that the Appellate Authority erred in reducing damages and keeping eviction in abeyance, as the PPE Act does not provide for such abeyance
NIC argued that the eviction order was invalid and damages were excessive
Ratio Decidendi
Under the Public Premises (Eviction of Unauthorised Occupants) Act, 1971, the Estate Officer has the power to order eviction and recover damages for unauthorised occupation. The Appellate Authority cannot reduce damages without proper justification or keep eviction in abeyance pending extraneous considerations like a High Power Committee decision.
Judgment Excerpts
Both the Petitions invoke the jurisdiction of this Court under Article 227 of Constitution of India to challenge the order of the Appellate Authority dated 26th October, 2010 passed in Misc. Appeal No 28 of 2009 filed against the order of the Estate Officer dated 18th December, 2009.
