Case Note & Summary

The petitioner, a minor student through her father, filed a writ petition challenging the rejection of her Scheduled Tribe certificate validation as 'Thakar' by the Scrutiny Committee. The petitioner claimed to belong to the Thakar community, a Scheduled Tribe in Maharashtra. The committee had rejected her claim citing contradictory entries in old revenue records showing some ancestors as 'Maratha' or 'Hindu Thakar'. The High Court examined the entries: an entry dated 5th June 1905 in the name of the petitioner's great grandfather showed him as 'Thakar'. Other entries of 1927, 1929, and 1940 in the names of other paternal ancestors also showed them as 'Thakar'. However, there were some contradictory entries showing the social status as 'Maratha' or 'Hindu Thakar'. The court noted that the oldest entry of 1905 was of sterling quality and had not been doubted. The court held that when there is a conflict between two sets of entries, the oldest entry should be relied upon as it is removed from manipulative modern times and has greater possibility of presenting truth. The court set aside the committee's order and directed the committee to validate the petitioner's caste certificate as 'Thakar' within four weeks. The writ petition was allowed.

Headnote

A) Evidence Law - Appreciation of Evidence - Oldest Entry Rule - In cases of contradictory entries regarding caste status, the oldest entry among them inspires more confidence as it is recorded in the distant past and has greater possibility of retaining purity and presenting truth - The court held that the conflict can be resolved by taking into consideration the oldest entry (Paras 3-5).

B) Scheduled Tribes - Caste Certificate Validation - Sterling Quality Evidence - Old entries of 1905, 1927, 1929, and 1940 showing ancestors as 'Thakar' are evidence of sterling quality and must be accepted unless contradicted by other entries - The court held that such entries have not been doubted for genuineness and establish the petitioner's tribal status (Paras 3-5).

Nature of Litigation

Writ petition challenging rejection of Scheduled Tribe certificate validation.

Remedy Sought

Petitioner sought validation of her Scheduled Tribe certificate as 'Thakar' and quashing of the Scrutiny Committee's order.

Filing Reason

The Scheduled Tribe Certificate Scrutiny Committee rejected the petitioner's claim for validation of her caste as 'Thakar' due to contradictory entries in old revenue records.

Previous Decisions

The Scrutiny Committee had rejected the petitioner's claim for validation of her Scheduled Tribe certificate.

Issues

Whether the conflict between entries showing ancestors as 'Thakar' and 'Maratha' should be resolved by selecting the oldest entry. Whether the petitioner is entitled to validation of her Scheduled Tribe certificate as 'Thakar'.

Submissions/Arguments

Petitioner argued that the oldest entry of 1905 showing 'Thakar' community is of sterling quality and should be relied upon. Respondent-State argued that contradictory entries create doubt and the committee's order should be upheld.

Ratio Decidendi

In cases of contradictory entries regarding caste status, the oldest entry among them should be relied upon as it is recorded in the distant past and has greater possibility of retaining purity and presenting truth.

Judgment Excerpts

We find there is an entry dated 5th June, 1905 standing in the name of Shambhurao Sarjerao, the great grand father of the Petitioner, showing him to be a person belonging to Thakar Community. We are of the view that the conflict between these two sets of entries can be resolved by taking into consideration the oldest entry amongst them for the reason that the oldest entries have been seen by Courts, as a tool of appreciation of evidence, to be inspiring more confidence, as these entries are recorded in the distant past and having been removed from the more manipulative modern times have a greater possibility of retaining purity and presenting truth.

Procedural History

The petitioner applied for validation of her Scheduled Tribe certificate as 'Thakar'. The Scrutiny Committee rejected the claim. The petitioner then filed the present writ petition before the Bombay High Court, which was heard and finally disposed of at the admission stage.
