Case Note & Summary

The case arises from a decree for specific performance of an agreement for sale dated 20th February 1989 in respect of agricultural land. The original plaintiff (now deceased) obtained a decree on 14th September 2004 directing the judgment debtors to execute a sale deed and hand over possession after the plaintiff deposited the balance consideration within one month. The decree also provided that if the judgment debtors failed to execute the deed, the plaintiff could get it executed through a court commissioner. In 2007, the decree holder filed an execution application (Special Darkhast No. 170 of 2007). During execution, the decree holder sought extension of time to deposit the balance consideration (Exhibit-10), while the judgment debtors filed an application under Section 47 of CPC to dismiss the execution (Exhibit-16). The executing court allowed the extension and rejected the judgment debtors' application. The judgment debtors challenged this order by way of writ petition. The High Court held that the executing court had discretion under Section 28 of the Specific Relief Act, 1963 to extend time for deposit, and that the decree was still alive and enforceable. The court also noted that the execution application was within limitation under Article 136 of the Limitation Act, 1963. The petition was dismissed, upholding the executing court's order.

Nature of Litigation

Writ petition challenging order of executing court allowing extension of time for deposit of balance consideration and rejecting judgment debtors' application under Section 47 CPC.

Remedy Sought

Petitioners (judgment debtors) sought to set aside the executing court's order dated 21st June 2012 allowing the decree holder's application for extension of time and rejecting their application under Section 47 CPC.

Filing Reason

The judgment debtors challenged the executing court's order on the ground that the decree had become unenforceable due to non-deposit of balance consideration within the stipulated time and that the execution application was barred by limitation.

Previous Decisions

The trial court decreed the suit for specific performance on 14th September 2004. The executing court by order dated 21st June 2012 allowed the decree holder's application for extension of time and rejected the judgment debtors' application under Section 47 CPC.

Issues

Whether the executing court was justified in extending time for deposit of balance consideration under Section 28 of the Specific Relief Act, 1963? Whether the application under Section 47 of CPC filed by the judgment debtors was rightly rejected?

Submissions/Arguments

Petitioners argued that the decree had become unenforceable as the decree holder failed to deposit the balance consideration within the time stipulated in the decree, and the execution application was barred by limitation. Respondents argued that the executing court had discretion to extend time under Section 28 of the Specific Relief Act, 1963, and the execution application was filed within the period of limitation under Article 136 of the Limitation Act, 1963.

Ratio Decidendi

The executing court has discretion under Section 28 of the Specific Relief Act, 1963 to extend time for deposit of balance consideration in a decree for specific performance, even after the period fixed in the decree, provided the decree is still alive and enforceable. The application under Section 47 CPC cannot be used to challenge the merits of the decree in execution proceedings.

Judgment Excerpts

The Petition takes exception to the order dated 21st June, 2012 passed by the Additional Judge, Small Causes Court and Joint Civil Judge, Senior Division, Pune below application Exhibit-“10” and Exhibit-“16” in Special Darkhast No. 170 of 2007 allowing the application below Exhibit-“10” and rejecting the application below Exhibit -“16”. Heard Mr. Atul Damle, learned Senior Advocate appearing for the Petitioners and Mr. Drupad S. Patil for the Respondents.

Procedural History

The original plaintiff filed Special Civil Suit No. 1922 of 1995 for specific performance, which was decreed on 14th September 2004. In 2007, the decree holder filed execution application (Special Darkhast No. 170 of 2007). On 18th December 2008, the decree holder filed an application for extension of time to deposit balance consideration (Exhibit-10). On 17th February 2009, the judgment debtors filed an application under Section 47 CPC (Exhibit-16). The executing court heard both applications and passed a common order on 21st June 2012, allowing Exhibit-10 and rejecting Exhibit-16. The judgment debtors challenged this order by filing Writ Petition No. 9800 of 2012, which was dismissed by the High Court on 12th September 2023.
