During the pendency of that appeal, the plaintiff filed the new suit alleging that the defendant was attempting to alienate the property. The trial court granted the injunction, which was challenged in this appeal. The High Court held that the plaintiff had made out a prima facie case, the balance of convenience was in his favor, and he would suffer irreparable loss if the injunction was not granted. The court dismissed the appeal, upholding the trial court's order.
