The petitioner, Himmat Dalichand Mali, an employee of the Municipal Corporation of Greater Mumbai (MCGM) belonging to the Vimukta Jati category, filed a writ petition seeking antedation of his promotion to the post of Assistant Law Officer with a deemed date of 3rd July, 2008, and further promotion to Deputy Law Officer. He also challenged the seniority list of Assistant Law Officers published on 13th July, 2021. The petitioner was appointed as Junior Law Officer on 31st December, 1998. Disciplinary proceedings were initiated against him on 8th February, 2008. His case for promotion to Assistant Law Officer was considered by the Departmental Promotion Committee on 18th June, 2008, but due to the pending disciplinary proceedings, he was not recommended. The disciplinary proceedings culminated in a penalty of withholding increments for three years on a permanent basis, which ended on 30th November, 2011. Another disciplinary proceeding was initiated in 2013, resulting in a censure and fine of Rs. 5,000. The petitioner was eventually promoted to Assistant Law Officer on 30th November, 2011, after the penalty period ended. He claimed that he should have been promoted from 3rd July, 2008, when his juniors were promoted. The court held that promotion cannot be antedated to a date when disciplinary proceedings were pending, as per settled law. The challenge to the seniority list was also dismissed due to delay and laches, as the list was published in July 2021 and the petition was filed in 2022. Additionally, the petitioner had not submitted a caste validity certificate, which was required for promotion benefits. The court dismissed the petition.
