Case Note & Summary

The case arises from a motor accident claim where the deceased died in a vehicular accident. The claimants, being the parents and widow of the deceased, filed a claim petition before the Motor Accident Claims Tribunal, Pune, which awarded compensation. The Insurance Company appealed against the award, raising several grounds: that the driver did not hold a valid driving license, that the deceased was under probation so his full salary should not be considered, that the widow remarried during pendency and thus should not be considered a dependent, that the consortium amount was excessive, and that the multiplier should be based on the parents' age rather than the deceased's age. The claimants filed a cross-objection seeking enhancement of compensation, arguing that bonus and leave encashment were not considered. The High Court heard both sides. On the issue of driving license, the court noted that the Insurance Company failed to examine any witness to prove the defense, and held that the defense must be proved by evidence. On remarriage, the court held that the widow was the deceased's wife at the time of filing and remarriage does not deprive her of compensation. On probation, the court held that probationary status does not reduce income. On multiplier, the court held that the multiplier should be based on the deceased's age. On consortium, the court found the amount excessive and reduced it. The court also rejected the claimants' cross-objection for enhancement. The appeal was partly allowed, reducing the consortium amount, and the cross-objection was dismissed.

Headnote

Nature of Litigation

Appeal against judgment and order of Motor Accident Claims Tribunal awarding compensation in a motor accident claim, and cross-objection for enhancement.

Remedy Sought

Insurance Company sought reduction of compensation; claimants sought enhancement.

Filing Reason

Insurance Company disputed liability on grounds of invalid driving license, probationary status of deceased, remarriage of widow, excessive consortium, and wrong multiplier.

Previous Decisions

Motor Accident Claims Tribunal, Pune awarded compensation to claimants.

Issues

Whether the Insurance Company proved that the driver lacked a valid driving license? Whether remarriage of widow during pendency of claim petition disentitles her to compensation? Whether the deceased's probationary status reduces his income for compensation? Whether the multiplier should be based on the parents' age instead of deceased's age? Whether the consortium amount awarded is excessive?

Submissions/Arguments

Appellant: Driver not holding valid license; deceased under probation so salary should not be considered; widow remarried so not dependent; consortium on higher side; multiplier should be based on parents' age. Respondents/Claimants: Bonus and leave encashment not considered; seek enhancement.

Ratio Decidendi

Insurance Company must prove defense of invalid driving license by evidence; remarriage of widow does not bar compensation; probationary status does not reduce income; multiplier based on deceased's age is correct; consortium amount can be reduced if excessive.

Judgment Excerpts

It is settled principle of law that if any defense is taken by the Insurance Company, it must be proved by producing evidence on record. Though the widow has remarried, deceased was her husband and, at the time of filing claim petition, she was widow of deceased. Hence, her remarriage cannot be a ground to deprive her from getting compensation. Though the deceased was under probation, it cannot be a ground to reduce his income.

Procedural History
