The petitioner, a Scheduled Caste teacher with qualifications M.A. (English), B.Ed., D.Ed., and MSCIT, was appointed as Assistant Teacher in an unaided school by respondent No.3 and 4 on 27/06/2011. The Education Officer (respondent No.2) granted approval to her appointment. In 2017, two teachers superannuated, creating vacancies in the aided section. The petitioner applied for transfer to those vacancies. The trust passed a resolution on 26/11/2021 transferring her from the unaided to the aided section. She joined duties on 29/11/2021. However, the Education Officer, by order dated 30/11/2021, withdrew the earlier approval granted to her initial appointment and directed the school to recover salary paid. The petitioner challenged this order. The court held that the transfer was within the same school and did not require prior approval of the Education Officer under the MEPS Act and Rules. The court also held that the withdrawal of approval without hearing was arbitrary. The petition was allowed, quashing the impugned order and directing the Education Officer to consider the transfer proposal afresh.
