Case Note & Summary
The petitioner, Pooja Naresh Lalwani, a student of Civil Engineering at Jawaharlal Darda Institute of Engineering & Technology, challenged the order dated 12.7.2019 passed by the District Caste Certificate Scrutiny Committee, Yavatmal, which invalidated her caste claim that she belongs to 'Kshatriya' – Other Backward Class (OBC). The petitioner claimed that 'Kshatriya' is recognized as OBC at Serial No. 126 under Government Resolution dated 25.6.2008 and Notification dated 26.9.2008. On 3.9.2015, the Sub-Divisional Officer, Yavatmal issued an OBC caste certificate in her favour. Subsequently, the Headmaster of her school sent a proposal to the Scrutiny Committee for verification. The Committee called upon the petitioner to produce documents, and she submitted eleven documents. However, the Committee noticed that in some documents, the caste of her relatives was shown as 'Sindhi', and was not satisfied. The Committee referred her claim to the Vigilance Cell under Rule 12(2) of the Maharashtra SC/ST/OBC Act, 2001 and Rules 2003. The Vigilance Cell conducted a detailed enquiry and submitted a report. However, the Scrutiny Committee passed the impugned order invalidating her claim without considering the Vigilance Cell report and the documents produced. The High Court held that the Committee failed to consider the Vigilance Cell report and relevant documents, violating principles of natural justice. The court set aside the order and remitted the matter back to the Committee for fresh consideration, directing the Committee to consider the Vigilance Cell report and all documents and pass a reasoned order within three months.
