The appeal arises from an order dated 3 November 2004 of a learned Single Judge of the Bombay High Court dismissing the Appellant's Writ Petition No.2611 of 2004. The Appellant, Shri Prakash Atmaram Atre, had challenged an order of the Cooperative Court (No. 2) at Bombay dated 30th August 2004, which dismissed his execution application (Execution Application No. 56 of 2004) as barred by limitation. The Appellant had obtained a decree against the Respondent, The Deccan Merchants Co-op. Bank Ltd., on 30th June 1997 in Summary Suit No. 56 of 1996 for recovery of Rs. 1,50,000 with interest. The Appellant's writ petition against that order was also dismissed by the Single Judge. The Appellant then appealed to the Division Bench. The Cooperative Court is directed to proceed with Execution Application No. 56 of 2004 on merits and in accordance with law.
