The acquiring body, Vidarbha Irrigation Development Corporation, had filed an appeal under Section 54 of the Land Acquisition Act, 1894 challenging the enhancement, while the land owner sought further enhancement through the cross objection. Initially, the High Court dismissed both the appeal and the cross objection, upholding the Reference Court's determination as just and proper. The land owner then appealed to the Supreme Court. The Supreme Court set aside the High Court's judgment and directed a fresh reconsideration of two specific issues: first, the valuation of trees based on the valuation report (Exhibit C-2) relied upon by the cross objector; and second, the classification of land bearing survey no.336 as either irrigated or dry crop land. The parties were in agreement that survey no.221 was irrigated land. The acquiring body did not challenge the dismissal of its appeal, and consequently, only the cross objection was taken up for adjudication afresh on the limited issues directed by the Supreme Court.
