The litigation arose from a civil suit instituted by the appellants for specific performance of an agreement of reconveyance dated 30th August, 1967. During the pendency of the suit, the appellants filed an application under Order 16 Rule 17 of the Code of Civil Procedure, 1908 seeking amendment of the plaint.
