The Court concluded that the Special Appellate Tribunal had initially accepted the explanation and should have stuck to that view and decided the appeal on merits. Therefore, the delay deserved condonation because it served a public purpose and required an exception for temple/trust properties. The Supreme Court set aside the impugned order dated 14 September 1978 and remanded the matter to the Special Appellate Tribunal for a decision on merits.
