Case Note & Summary

The case arose from land acquisition proceedings under the Land Acquisition Act, 1894. A notification under Section 4(1) was published on July 3, 1979, for acquisition of land. The Land Acquisition Collector classified the land and awarded compensation at rates varying from Rs.2,000 to Rs.3,000 per bigha. Aggrieved claimants sought reference under Section 18. The reference court enhanced the market value to Rs.6,500 to Rs.8,500 per bigha while maintaining the classification of the land. The acquiring body appealed to the Guwahati High Court, which by judgment and decree dated January 30, 1989, in First Appeal No.81/86 and connected cases, affirmed the reference court's award. Dissatisfied, the acquiring body filed special leave petitions before the Supreme Court. The Supreme Court examined the judgments of the reference court and the High Court. On the facts and circumstances, the Court held that the appropriate market value of the lands as on the date of notification would be Rs.4,875 and Rs.6,375 per bigha respectively, instead of Rs.6,500 and Rs.8,500. The Court also held that since the award of the reference court was made after the Land Acquisition (Amendment) Act, 1984 (Act 68 of 1984) came into force, the claimants were entitled to statutory benefits under the Amendment Act. Accordingly, the claimants were entitled to 30% solatium on the enhanced compensation, interest at 9% for one year and 15% thereafter from the date of taking possession on the enhanced compensation till the date of deposit or payment, whichever was earlier, and 12% additional amount under Section 23(1-A) of the Act. The Court modified the award and decree of the reference court accordingly, directed the appellants to deposit the amount, if not already deposited, within eight months from the date of receipt of the order, and made no order as to costs.

Nature of Litigation

Land acquisition compensation dispute arising from acquisition of land for Hindustan Paper Corporation, challenged by landowners seeking enhanced compensation and acquiring body seeking reduction of market value fixed by reference court and High Court.

Remedy Sought

Appellant Hindustan Paper Corpn. Ltd. sought reduction of enhanced compensation awarded by the reference court and affirmed by Guwahati High Court.

Filing Reason

Dissatisfaction with the market value fixed at Rs.6,500 to Rs.8,500 per bigha by reference court and High Court, contending it was excessive and not reflective of prevailing market value on notification date.

Previous Decisions

Land Acquisition Collector awarded Rs.2,000 to Rs.3,000 per bigha; Reference Court under Section 18 enhanced to Rs.6,500 to Rs.8,500 per bigha; Guwahati High Court in First Appeal No.81/86 and connected cases affirmed the reference court's award and decree on January 30, 1989.

Issues

What was the correct market value of the acquired lands as on the date of notification under Section 4(1) of the Land Acquisition Act, 1894? Whether the claimants were entitled to statutory benefits under the Land Acquisition (Amendment) Act, 1984 (Act 68 of 1984) when the reference court award was made after the Amendment Act came into force?

Submissions/Arguments

Appellant contended that the market value fixed by the reference court and affirmed by the High Court was excessive and not in accordance with prevailing market value. Respondents/claimants contended that they were entitled to enhanced compensation and statutory benefits under Amendment Act 68 of 1984 as the award was made after the Amendment Act came into force.

Ratio Decidendi

The Supreme Court reassessed the market value of acquired land as on the date of notification under Section 4(1) of the Land Acquisition Act, 1894, and determined it at Rs.4,875 and Rs.6,375 per bigha for the respective classifications. Since the reference court award was made after the Land Acquisition (Amendment) Act, 1984 came into force, the claimants were entitled to the enhanced statutory benefits under the Amendment Act, including 30% solatium, interest at 9% for one year and 15% thereafter from date of possession, and 12% additional amount under Section 23(1-A).

Judgment Excerpts

Notification under s.4(1) of the Land Acquisition Act 1 of 1898 (for short ‘the Act’) was published on July 3, 1979. We found, on the facts and circumstances of the case, that appropriate market value would be Rs.4,875/- and Rs.6,375/- instead of Rs.6,500/- and 8,500/- respectively for the lands as it would reflect the prevailing market value as on the date of the Notification, namely, July 3, 1979. Award of the reference court being made after the Amendment Act had come into force, the claimants are entitled to the statutory benefits of the Amendment Act 68 of 1984. Accordingly, the claimants are entitled to 30% solatium on the enhanced compensation, 9% interest for one year and 15% interest thereafter from the date of taking possession on the enhanced compensation till date of deposit or payment, whichever is earlier.

Procedural History

Notification under Section 4(1) of Land Acquisition Act, 1894 published on 03-07-1979; Land Acquisition Collector awarded Rs.2,000-Rs.3,000 per bigha; on reference under Section 18, reference court enhanced market value to Rs.6,500-Rs.8,500 per bigha maintaining classification; Guwahati High Court in First Appeal No.81/86 and connected cases affirmed the reference court's award and decree on 30-01-1989; appeals by special leave filed before Supreme Court; Supreme Court reassessed market value and modified award.
