Ratio Decidendi
Where the Recruitment Rules provide PST teachers as the feeder category for promotion to Classical and Vernacular teacher posts, those Classical and Vernacular teachers cannot thereafter be excluded from consideration for promotion to the higher post of Master/Mistress (TGTs). Interpreting the Rules literally to permit only PST teachers for promotion to Master while they are also the feeder for Classical teachers would create absurdity and cause unjust advantage to a lower post over a higher post, which cannot be sustained.

Such an interpretation of Rule will not only cause great injustice but will create absurdity by giving unwarranted advantage to the incumbents of the lower post of PST teacher over the incumbents of the higher post of a Classical teacher, and such an interpretation cannot be sustained in law.
The Tribunal, therefore, was wholly justified in giving harmonious construction to both the Rules and interpreting the Rule in a manner which would make rules of Recruitment to both the categories of post namely, master/mistress (TGTs) and Classical and Vernacular teachers legal and valid.
PST teacher being feeder category for promotion to the post of Classical and Vernacular teachers under the Recruitment Rules in question, the said Classical and Vernacular teacher can not be debarred for being considered for promotion to the post of Master/Mistress (TGTs).
Procedural History
The respondents were promoted to Master/Mistress posts in 1993. Chandigarh Administration issued show-cause notices on 3 January 1995 to cancel/withdraw promotions. Respondents approached Central Administrative Tribunal, Chandigarh, filing O.A. Nos. 138/CH/95, 137/CH/95 and 121/CH/95. Tribunal quashed the notices and restrained cancellation/withdrawal of promotions by orders dated 12 October 1995, 9 November 1995 and 14 November 1995 respectively. Chandigarh Administration filed special leave petitions before Supreme Court, which granted leave and heard the appeals together.
