The State of Karnataka contended that a probationer could not be treated as confirmed merely on satisfactory completion of probation until an order of confirmation was passed, relying on Rules 5 and 9 of the Probation Rules. The court accepted that there was force in the contention that formal confirmation order is necessary, but held that formal confirmation cannot be unreasonably delayed, especially where confirmation is a precondition for better service conditions. The court noted the Revised Gradation List showing appellants were confirmed against vacancies from 25.6.1962 and 4.7.1962, while respondents in the zone had been confirmed against vacancies from 5.2.1963 and 31.7.1976. The court found no cogent reason for the late confirmation from 1.1.1986, since probation was completed as early as 14.7.1976. Concluding that the appellants were eligible for consideration in December 1983, the court directed the Union of India to assign year of allotment as if their selection for promotion to IAS occurred in 1983, not 1987, and to pass necessary orders within two months.
