The Court held that until probation is declared and confirmation is made, the person does not become a member of the service; mere passage of time does not confer that status. Since the appellant passed the test later, the appointing authority was justified in assigning seniority from the date of passing the test under Rule 12(a)(ii). No illegality was found.
