The dispute arose from land acquisition proceedings initiated by Krishi Utpadan Mandi Samiti Bulandshahr for establishing an agricultural market yard. Notification under Section 4(1) of the Land Acquisition Act, 1894 was published on May 25, 1976, and the Collector made an award under Section 11 on May 10, 1977. On reference, the Additional District Judge enhanced compensation to Rs.10 per sq. yd. with solatium at 15% and interest at 6% vide award and decree dated September 15, 1979. The High Court on appeal further enhanced compensation to Rs.15 per sq. yd. and, applying the Land Acquisition (Amendment) Act, 1984 (Act 68 of 1984), granted enhanced solatium of 30%, interest at 9% for one year from date of taking possession and 15% thereafter till deposit, and additional amount under Section 23(1-A). The Supreme Court accepted the appellant's submission on the second point, holding that claimants were not entitled to the benefits introduced by Act 68 of 1984 because the reference court award predated the amendment. Consequently, the enhancement of 30% solatium, interest at 9% for one year and 15% thereafter, and additional amount under Section 23(1-A) was set aside. The Court directed that claimants would instead receive solatium at 15% and interest at 6% on the enhanced compensation from the date of taking possession till date of deposit, as per the interim order. On the first point, although the Court was not satisfied with the reasoning of the Division Bench, it declined to interfere with the enhancement of compensation to Rs.15 per sq. yd., observing that the principle involved in determining compensation could not be faulted. The appeals were disposed of accordingly with no order as to costs.
