The dispute concerned promotions to posts in the Rajasthan Service of Engineers (Building and Roads Branch) under the Rajasthan Service of Engineers (Building and Roads Branch) Rules, 1954. The State of Rajasthan appealed against a Division Bench judgment of the Rajasthan High Court, Jaipur Bench, which had allowed a writ petition challenging promotions of two officers. Nine vacancies existing and anticipated as on April 1, 1995 were identified. A Departmental Promotion Committee met on April 13, 1995 and selected candidates under the rules then in force. The original writ petitioners challenged the appointments, contending that the amended rules should apply to vacancies arising after that date. The core legal issue was whether appointments of B.S. Bhatnagar and H.L. Meena were valid insofar as they related to vacancies arising after the amendment, and whether a carried forward vacancy could be filled under pre-amendment rules. The State contended that under Rule 9, vacancies were determined as on April 1 and the DPC correctly applied Rule 23 criteria as they existed on the date of selection. A promotee-respondent argued that selection criteria as on the date of DPC should govern. The contesting respondents relied on V.V. Rangaiah v. J. Sreenivasa Rao and argued that amended rules must apply from the date of their effectiveness. The Supreme Court noted that Rule 9 provides for determination of vacancies as on the first day of the financial year, and Rule 23 prescribes criteria for DPC. Rule 12(2) requires minimum qualifications and experience as on the first day of April of the year of selection. The amendment, effective July 24, 1995, introduced Rule 24-A and clause (11-B) allowing the Government to revise select lists. Following V.V. Rangaiah, the Court held that vacancies which occurred prior to amendment were governed by original rules, while vacancies subsequent to amendment must be filled under amended rules. Since the selection had been made before the amendment but included anticipated vacancies for the whole financial year, appointments to post-amendment vacancies were not in accordance with law. The Court rejected the argument that a carried forward vacancy could bypass amended rules, stating that even carried forward vacancies must be considered under the law existing when the vacancy arose. The Court directed that the appointments of B.S. Bhatnagar and H.L. Meena be treated as temporary pending fresh DPC. It modified the High Court judgment only with respect to B.L. Kankas, whose promotion was left undisturbed due to retirement. The Government was directed to constitute a DPC within eight weeks to consider eligible candidates and make fresh selections. Benefits already given were not to be taken away, but seniority would be subject to the fresh decision. The appeal was disposed of without costs.

The only question is : whether the appointment of the said respondents, viz., B.S. Bhatnagar and H.L. Meena, is made in accordance with the Rules. This Court has specifically laid that the vacancies which occurred prior to the amendment of the Rules would be governed by the original Rules and not by the amended Rules. As a necessary corollary, the vacancies that arose subsequent to the amendment of the Rules are required to be filled in in accordance with the law existing as on the date when the vacancies arose. Even a carried forward vacancy is required to be considered in accordance with the law existing unless suitable relaxation is made by the Government. The Government is directed to constitute the DPC within a period of eight weeks from the date of the receipts of the order and take speedy action accordingly.
