The incident arose from a long-standing dispute over land between Kumar, the father of the deceased, and the accused. On October 13, 1977, when Bandhoo attempted to plough the disputed land, he was attacked by the accused, leading to his eventual death from injuries sustained during the assault. A written report was filed by Kumar, resulting in the registration of a case against the accused. The trial court convicted all five accused based on the testimonies of eyewitnesses and corroborating evidence, which was upheld by the High Court. The Supreme Court, however, found that while the evidence supported the conviction, the common object of the accused was not to commit murder but to inflict grievous hurt. Consequently, the court altered the convictions of the surviving accused from murder-related charges to those of grievous hurt and maintained some of the other convictions. The court also considered the time served by the accused and reduced their sentences to the period already undergone, ordering their release unless required in other cases. The appeal was thus disposed of.
