The Supreme Court, upon reviewing Rule 9 of the Punjab P.W.D. (Electricity Branch) Provincial Service Class III (Subordinate Posts) Rules, 1952, found that the appellant's promotion was regular and not temporary. The Court held that his seniority should be determined from the date of his appointment as Deputy Superintendent, thus entitling him to promotion as Superintendent from the same date as his juniors. The Court set aside the High Court's decisions and directed the Board to treat the appellant as promoted to Superintendent from the date of his juniors' promotion, with appropriate emoluments adjusted accordingly.
