Case Note & Summary

The dispute arose from a land acquisition case involving 7.60 acres of land in Shillong, owned by five respondents. Following a notification under section 4 of the Land Acquisition Act on 27th March 1967, the Collector took possession of the land. Negotiations led to a reduction in the compensation amount from Rs. 6,17,683.50 to Rs. 4,41,202.45, contingent upon payment by 31st March 1969. The respondents agreed to this reduction and signed an agreement stating they would make no further claims regarding compensation if payment was made on time. After payment was made, the respondents sought interest on the compensation amount, which the Collector denied, leading them to approach the High Court. The High Court ruled in favor of the respondents, stating that the agreement did not preclude interest claims under section 34 of the Act. The State appealed to the Supreme Court, which found that the agreement's language indicated a full settlement of claims, including interest. The court concluded that the respondents had relinquished their right to claim interest by accepting the agreed amount without reserving such rights. Consequently, the Supreme Court set aside the High Court's judgment and dismissed the respondents' petition without costs.

Headnote

A) Land Acquisition - Agreement Interpretation - Exclusion of Interest Claims - Land Acquisition Act, 1894, Sections 23 and 34 - The expression 'would not make any further claim in regard to compensation' was interpreted to mean full satisfaction of the claim, thus excluding future interest claims. The court held that the respondents condoned the delay in payment and relinquished all future claims to interest by accepting the quantified sum. Held that the agreement did not reserve rights to claim interest under section 34 (Paras 853-854).
