Case Note & Summary
The dispute arose between an employee and the Punjab Financial Corporation regarding the termination of the employee's service. The appellant, Anil Kumar Soni, was initially appointed as an Assistant Technical Officer and confirmed in that role on 14.7.1976. He later applied for and was appointed as an Assistant Manager on probation on 26.5.1980. His probation was extended, but he was ultimately terminated from the Assistant Manager position on 11.5.1984. The appellant filed a writ petition against this termination, which was dismissed by the High Court. The core issue was whether the appellant could continue in his previous role as Assistant Technical Officer after his termination from the Assistant Manager position. The Corporation argued that the post of Assistant Technical Officer was abolished upon his selection for the new role. The Supreme Court found that the resolution of the Board indicated that only a confirmed appointment in the new cadre would abolish the previous post. The court ruled that it would be unjust to deny the appellant his previous position after nine years of service. Consequently, while the termination from the Assistant Manager position was upheld, the court directed the Corporation to allow the appellant to continue as Assistant Technical Officer with back wages and benefits, or appoint him to an equivalent position if that post no longer existed. The Corporation was ordered to comply within one month.
Headnote
A) Employment Law - Termination of Service - Justification of Termination - Punjab Financial Corporation (Staff) Regulations, 1961, Regulation 19(2) - The appellant's termination from the post of Assistant Manager was upheld; however, he was entitled to continue on the post of Assistant Technical Officer as he was confirmed in that position prior to his appointment as Assistant Manager. The court emphasized that a confirmed employee should not lose their previous position without proper confirmation in the new post (Paras 185-188).
Issue of Consideration
Whether the termination of service of the appellant from the post of Assistant Manager was justified and if he was entitled to continue on the post of Assistant Technical Officer.
Final Decision
The Supreme Court upheld the termination from the Assistant Manager position but directed the Corporation to allow the appellant to continue as Assistant Technical Officer with back wages and benefits, or appoint him to an equivalent position if the original post was not available.
