Case Note & Summary

The dispute arose from the retirement of S.P. Dubey from the Madhya Pradesh State Road Transport Corporation upon reaching the age of 58 years, which he contested on the grounds that the age of superannuation was 60 years as per the original terms of employment with the private company taken over by the State. Dubey had joined the Central Provinces Transport Service Limited in 1947, where the age of superannuation was fixed at 60 years. Following the takeover by the State on August 31, 1955, a notification assured that existing staff would not face adverse changes in their service conditions. The Madhya Pradesh State Road Transport Corporation was established later, and its regulations stipulated a retirement age of 58 years. Dubey challenged his retirement in the High Court, which upheld the application of the State Service Rules. The Supreme Court, however, found that the assurances given by the State Government were binding and that the Corporation could not impose a lower retirement age contrary to those assurances. The Court ruled that Dubey was entitled to continue until 60 years of age and directed the Corporation to pay him two years' emoluments, quantifying costs at Rs. 5,000. The appeal was allowed, and the High Court's judgment was set aside.

A) Employment Law - Age of Superannuation - Assurance of Service Conditions - Road Transport Corporation Act, 1950, Section 34 - The appellant was entitled to continue in service up to the age of 60 years as the State Government had assured that the conditions of service would not be adversely affected upon takeover of the private company. The Court held that the State Service Rules fixing the age at 58 years could not apply to the appellant, and the Corporation's regulations could not override the assurances given by the State Government (Paras 1-4).
