Case Note & Summary

The Supreme Court of India dealt with a Special Leave Petition concerning anticipatory bail filed by the petitioner against the State of Haryana. The High Court of Punjab and Haryana had previously granted interim anticipatory bail to the petitioner, contingent upon her paying a sum of Rs. 1 lakh to the complainant. Subsequently, it was revealed that the First Information Report (FIR) related to the case had been quashed by the High Court due to a compromise between the parties, which was formalized in an order dated 8th May 2007. This compromise also led to a mutual divorce under Section 13-B of the Hindu Marriage Act, 1955. The Supreme Court noted that since the FIR was quashed, the Special Leave Petition had become irrelevant. The Court also acknowledged that the petitioner had complied with a prior order to deposit Rs. 1 lakh with the Registrar General of the Punjab & Haryana High Court, which was unrelated to the terms of the compromise. Consequently, the Court directed that the deposited amount be returned to the petitioner. The Special Leave Petition was thus disposed of.
