Case Note & Summary

The case involved an appeal by the Union of India against a judgment of the Allahabad High Court concerning a claim for interest on a rebate amount of Rs.15,07,791/- by M/s Upper Ganges Sugar & Industries Ltd. The dispute originated from a notification issued by the Central Government in 1974, which allowed rebates on sugar production. The Respondents initially claimed a rebate of Rs.27,84,474/- but were granted only Rs.12,76,621/- by the Assistant Collector. After exhausting various appeals, the Tax Tribunal ruled in favor of the Respondents in 1992, allowing the credit but not the interest. In 1993, the Respondents sought interest on the rebate amount, which was rejected by the Assistant Collector and subsequently by the Collector (Appeals) and the Tribunal. The Allahabad High Court later ruled in favor of the Respondents, granting them interest at 10%. The Supreme Court, however, found that the Tribunal's earlier decision did not grant interest, and thus the Respondents could not claim it again. The Court noted that the question of entitlement to the rebate was not free from doubt, and therefore, even if interest could be granted on equitable grounds, it was not applicable in this case. Consequently, the Supreme Court set aside the High Court's judgment and allowed the appeal without costs.

Nature of Litigation

Appeal against a judgment regarding interest on a rebate claim.

Remedy Sought

The Union of India sought to overturn the High Court's decision granting interest.

Filing Reason

The Respondents claimed interest on a rebate amount that was not paid earlier.

Previous Decisions

The Tribunal had previously ruled on the rebate but did not grant interest.

Issues

Entitlement to interest on delayed payment Validity of the claim for interest after Tribunal's order

Submissions/Arguments

The Respondents argued they were entitled to interest based on the delay in payment. The Appellants contended that the Tribunal did not grant interest, thus the claim was not valid.

Ratio Decidendi

The Tribunal's failure to grant interest in its order precluded the Respondents from claiming it later, and the absence of statutory provision for interest under the Central Excise and Salt Act was a significant factor.

Judgment Excerpts

The Respondents are entitled to interest at the rate of 10%. It is hoped that this sorry state of affairs will get remedied.

Procedural History

The Respondents filed a claim for rebate, which was partially granted. They pursued appeals through various levels, culminating in a Writ Petition in the Allahabad High Court, which was allowed before the Supreme Court appeal.
