Case Note & Summary

The dispute arose from a series of transactions involving the re-conveyance of property executed by Ramakrishna Mudaliar in favor of Mrs. Rajaby Fathima Buhari. An agreement dated 24.3.1959 stipulated that if the purchase amounts were repaid within three years, the properties would be re-conveyed. After Mrs. Buhari failed to re-convey the property, a suit for specific performance was filed by Mudaliar and his son Matha Prasad, which was initially decreed but later appealed by the Buharis. Following the death of the original parties, Matha Prasad assigned his rights to the assignees, Lalchand Meghraj and Chimandas Meghraj. The assignees sought to be impleaded in the execution proceedings initiated by Matha Prasad, but their applications were dismissed on grounds of limitation. The Division Bench later allowed an appeal against this dismissal, leading to the present appeal by Matha Prasad. The Supreme Court found that the Division Bench had improperly addressed the merits of the case rather than confining its decision to the limitation issue. The Court endorsed the Division Bench's findings on limitation but set aside its decision on merits, remanding the case for a fresh hearing on the merits while allowing all parties to raise their legal pleas. The appeals were disposed of accordingly.

Issues

Whether the Division Bench was justified in addressing the merits of the case after condoning the delay in filing applications.

Submissions/Arguments

Appellant argued that the Division Bench should not have addressed merits as the issue was solely about limitation. Respondents contended that limitation and the right of assignees were closely interlinked.

Ratio Decidendi

The Division Bench's decision to address the merits of the case was inappropriate as the only issue before it was the question of limitation.
