Case Note & Summary

The dispute arose from the appellants' completion of the Industrial Training Institute (ITI) course in 'Fitter' at an institution run by the Kerala State Government from 1996 to 2002. The appellants were led to believe, through the prospectus, that upon successful completion of the course, they would receive National Trade Certificates issued by the National Council for Vocational Training (NCVT). However, upon completion, they were only given provisional certificates because the institute was not affiliated for the trade of 'Fitter' during that period. The appellants filed writ petitions after being denied the certificates, but the High Court ruled against them, citing the lack of NCVT recognition for the course. Previous cases with similar circumstances had resulted in the issuance of certificates, which were complied with by the State. The learned Additional Solicitor General argued that the appellants should also receive their certificates based on the representations made and the precedent set by earlier decisions. The Supreme Court agreed, directing the NCVT to issue National Trade Certificates to the appellants and allowing them to submit applications for the same. The court ordered that the certificates be issued within three months, thereby resolving the appeals without costs.
