Case Note & Summary

The dispute arose from an application filed under Section 29-A(5) of the U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, by the predecessor of the respondents for determining the standard rent of a property let out to Esso Eastern Inc. The lease, established by a registered deed dated 11th January, 1971, allowed the tenant to operate a petrol station and was for a term of ten years at a monthly rent of Rs.450/-. Following the acquisition of Esso Eastern Inc. by the Government of India under the Esso (Acquisition of Undertaking in India) Act, 1974, Hindustan Petroleum Corporation Ltd. (HPCL) became involved in the proceedings. HPCL contended that it had a right to renew the lease for an additional ten years, which it exercised before the original lease expired. The District Magistrate assessed the standard rent at Rs.50,000/- per month based on a valuation report, which was later confirmed by the High Court. The Supreme Court was tasked with determining the correct date for the application of the new rent and the validity of the fixed amount. The court found merit in HPCL's argument regarding the renewal period but noted that HPCL failed to produce necessary evidence to challenge the valuation. Consequently, the court ruled that the standard rent would apply from 15th March, 2000, rather than 15th March, 1990, and upheld the High Court's decision regarding the rent amount. The court also clarified that it would not comment on a pending eviction suit under the Transfer of Property Act, keeping all parties' rights intact. The appeal was partly allowed with no order as to costs.

Headnote

A) Rent Control - Standard Rent Determination - Applicability Date - U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, Section 29-A(5) - The court held that the District Magistrate erred in determining the standard rent from 15th March, 1990, as the appellant had exercised its statutory right for lease renewal until 14th March, 2000 under the 1974 Act. The court directed that the standard rent should be applicable from 15th March, 2000 instead (Paras 1-2).

B) Rent Control - Evidence for Standard Rent - U.P. Urban Buildings (Regulation of Letting, Rent and Eviction) Act, 1972, Section 9(2) - The court found no infirmity in the High Court's confirmation of the standard rent fixed at Rs.50,000/- per month, as the appellant did not provide evidence challenging the valuation report. The court noted that the appellant's claim as a statutory tenant did not affect the determination of standard rent (Paras 2-3).
