Case Note & Summary

The dispute arose over land plots 170 and 171 in village Ludohi, District Mau, U.P. The appellants, Nageshwar and another, initially had the plots recorded in their names as 'abadi samil jot' by the Consolidation Officer on 5.6.1984. Subsequent mutations were made in their favor on 23.9.1991 and 14.11.1991. However, the respondent challenged the 1991 order, leading to the Settlement Officer (Consolidation) setting aside the earlier order and remanding the case for a fresh decision on 10.8.2005. The appellants filed a revision under section 48 of the U.P. Consolidation of Holdings Act against this order, which was dismissed by the Deputy Director (Consolidation). The Deputy Director also set aside the earlier orders of the Consolidation Officer and directed that the land be recorded as 'Navin Parti'. The appellants' writ petition against this decision was dismissed by the High Court. The Supreme Court found that the Deputy Director had acted beyond his authority by setting aside orders that were not under challenge and failing to remand the matter properly. The court allowed the appeal in part, set aside the direction to record the land as 'Navin Parti', and remitted the matter to the Consolidation Officer for a fresh decision with an opportunity for hearing. No costs were awarded.
