Case Note & Summary

The dispute arose between a poultry farming company and the Power Grid Corporation of India regarding the alignment of a high voltage transmission line over the company's poultry sheds. The appellant, a private limited company, had invested approximately Rs. 6 crores in establishing its poultry farm on lands acquired in two stages in 2004. The Corporation's construction of the transmission line required the installation of towers on lands that included the appellant's property. The appellant raised concerns about the adverse effects of electromagnetic fields on the health and productivity of its layer birds and sought a realignment of the transmission lines. The District Magistrate initially directed a realignment to avoid the poultry sheds, but this order was challenged by a neighboring landowner, leading to a dismissal by the High Court. The appellant contended that the District Magistrate acted within his jurisdiction under Section 17 of the Telegraph Act, while the Corporation argued that the order was not feasible and that the appellant had prior knowledge of the project. The court ultimately found that the District Magistrate had the authority to direct a change in alignment and ordered the Corporation to increase the clearance of the transmission lines to mitigate potential harm to the poultry farm. The appeal was allowed, and the appellant was entitled to compensation for the use of its land. The court emphasized the need to balance public interest with the appellant's investment and the health of its poultry. (Paras 1-30).

Issues

Jurisdiction of the District Magistrate under the Indian Telegraph Act Impact of electromagnetic fields on poultry health

Submissions/Arguments

The appellant argued that the District Magistrate had the authority to direct a change in alignment under Section 17. The Corporation contended that the order was not feasible and that the appellant had prior knowledge of the project.

Ratio Decidendi

The District Magistrate has the authority under Section 17 of the Indian Telegraph Act to direct changes in the alignment of transmission lines to mitigate adverse impacts on private property.

Judgment Excerpts

The District Magistrate directed the Corporation to realign the transmission power line in such a way that it did not pass above the poultry sheds of the appellant. The simplest and the most ideal solution would have been to alter the route of the transmission lines so that they did not directly pass over the appellant’s poultry sheds. We set aside the order of the Division Bench of the Madras High Court impugned in this appeal and direct the Power Grid Corporation to increase the clearance indicated above from 52 meters to 56 meters.

Procedural History

The appellant filed Writ Petition No.6850/06 before the High Court, which was disposed of with directions to the District Magistrate. The District Magistrate issued an order for realignment, which was challenged by the first respondent and dismissed by the High Court. The Division Bench later allowed the appeal against the District Magistrate's order, leading to the present appeal.
