Case Note & Summary

The dispute arose between the Kerala State Cashew Development Corporation Ltd. and N. Asokan regarding the payment of gratuity. The High Court had directed the Corporation to pay gratuity with interest to the respondent, which led to the appeal in the Supreme Court. During the appeal, it was acknowledged that the gratuity amount had already been paid, leaving the question of interest on the delayed payment. The Supreme Court examined Section 7 of the Payment of Gratuity Act, 1972, particularly subsection 3A, which stipulates that if gratuity is not paid within the specified period, the employer must pay simple interest from the due date until payment is made. The court noted that the employer had not obtained written permission from the controlling authority for the delay, which was a necessary condition to avoid paying interest. The Corporation argued that its financial condition prevented timely payment, but the court found this explanation insufficient given the mandatory nature of the statute. The Supreme Court dismissed the appeal, affirming the High Court's order and granting the Corporation six weeks to pay the interest due on the delayed gratuity. The court clarified that this order should not be treated as a precedent in similar cases.

In this case, the employer did not obtain such permission, and thus interest was mandated on the delayed gratuity payment of eight years. Held that the High Court's decision to affirm the payment of interest was justified (Paras 6-8).

Nature of Litigation

Civil appeal regarding payment of gratuity and interest.

Remedy Sought

The appellant sought to challenge the High Court's order directing payment of gratuity with interest.

Filing Reason

The appeal was filed against the High Court's affirmation of the Single Judge's order.

Previous Decisions

The High Court had directed the payment of gratuity with interest, which was affirmed by the Supreme Court.

Issues

Whether interest on delayed payment of gratuity should be paid Whether the employer's financial condition justifies the delay in payment

Submissions/Arguments

The employer argued financial incapacity to pay gratuity on time. The respondent contended that the employer failed to comply with statutory obligations.

Ratio Decidendi

The employer is liable to pay interest on delayed gratuity payments unless written permission for delay is obtained from the controlling authority, as mandated by Section 7(3A) of the Payment of Gratuity Act, 1972.

Judgment Excerpts

The only question that remains to be considered for us is whether interest on such delayed payment of gratuity amount should also be directed to be paid to the respondent. The employer shall pay, from the date on which the gratuity becomes payable to the date on which it is paid, simple interest at such rate, not exceeding the rate notified by the Central Government. No such permission was obtained by the employer in writing from the Controlling authority and, therefore, sub-section (3A) and its term would be squarely applicable.

Procedural History

The appeal arose from a Special Leave Petition against the High Court's order affirming the Single Judge's decision directing gratuity payment with interest.
