Case Note & Summary

The dispute arose from a contract for the construction of the Earth Dam of Kuanaria Irrigation Project, which was executed in Puri District. The appellant, State of Orissa, entrusted the construction work to the respondent, Durga Charan Routray. Following the completion of the work, disputes emerged, leading to arbitration, where an award was made in favor of the respondent for Rs.34.81 lakhs plus interest on March 7, 2003. The appellant filed an application under Section 34 of the Arbitration & Conciliation Act, 1996, on June 25, 2003, in the District Court of Khurda, which was later dismissed due to lack of jurisdiction. The respondent initiated execution proceedings, and the executing court ordered the appellant to deposit the award amount, allowing the respondent to withdraw it upon furnishing security. The appellant challenged both the jurisdictional order and the execution order in appeals to the Orissa High Court, which dismissed both appeals in a common order on December 23, 2009. The Supreme Court, upon hearing the matter, determined that the executing court had acted improperly by allowing execution before the expiry of the time for filing an application to set aside the arbitral award. The Court dismissed the appeal against the jurisdictional order, permitted the appellant to re-present the application under Section 34 in the proper court, and set aside the execution order, directing the deposit of the award amount in the District Court of Puri pending the application’s hearing. The Court also requested the District Judge to expedite the decision on the application under Section 34.
