Case Note & Summary

The case involved the appellants, Modern Dental College and Research Centre and others, who filed applications seeking modification of the scheme for filling Non-Resident Indian (NRI) seats in medical and dental colleges in Madhya Pradesh. The appellants challenged the constitutional validity of the Madhya Pradesh Niji Vyavsayik Shikshan Sanstha (Pravesh Ka Viniyaman Avam Shulk ka Nirdharan) Adhiniyam, 2007, with writ petitions pending before the High Court. The Supreme Court had previously ruled that both the State Government and the Association of Private Medical and Dental Colleges would conduct separate entrance examinations, and NRI seats were to be filled as per the Act and Rules. The court reiterated that unfilled NRI seats should be transferred to the general pool for filling based on merit from the State level common entrance test. The appellants sought to fill NRI seats at their discretion, but the court found no grounds for interference with the existing arrangements for the academic year 2011-12. The court requested the High Court to expedite the resolution of the pending writ petitions, emphasizing the need for a timely and reasoned judgment. The applications were disposed of, and the parties were directed to bear their own costs.

Judgment Excerpts

The appellants have filed these applications for modification of the scheme contained in the order dated 27.5.2009. The main question which has been articulated by the learned counsel for the parties is regarding the method and procedure for filling the unfilled NRI seats in medical and dental colleges. The Court made arrangement for the academic year 2009-10. The same arrangement was continued for the next academic year 2010-2011. We have heard learned counsel for the parties at length. In our considered view, no interference is called for as far as academic year 2011-12 is concerned. The High Court is requested to decide the case as expeditiously as possible and, in any event, within two months from the date of the communication of this order.

Procedural History

The appellants filed applications for modification of the scheme for filling NRI seats in 2011, following a previous order from 2009. The Supreme Court had previously ruled on the filling of NRI seats and continued the arrangement for subsequent academic years.
