Case Note & Summary

The case involved an appeal against a conviction for corruption under various sections of the Indian Penal Code and the Prevention of Corruption Act. The appellant, Munilal Mochi, was convicted by the Special Judge (Vigilance), Patna, for offences related to the misappropriation of government funds under the National Rural Employment Programme (NREP) and sentenced to two and a half years of rigorous imprisonment. Following an appeal, the High Court reduced the sentence to one and a half years. The appellant contended that he was not named in the FIR and had faced trial for nearly 25 years, during which he had already served six months in prison. The Supreme Court, while hearing the appeal, focused solely on the sentence. The court acknowledged the appellant's age of 71 years, the lengthy duration of the trial, and the absence of prior criminal involvement. The court noted that the minimum sentence under the Prevention of Corruption Act was one year but had the discretion to impose a lesser sentence for special reasons. Ultimately, the Supreme Court modified the sentence to the six months already served, confirming the conviction but reducing the punishment to align with the circumstances of the case.
